Regulations on archival review of regulations and normative documents of the China Association for democracy promotion

A few days ago, the twenty-one session of the fourteen chairman of the DPP held a deliberation and approval of the regulations for the record and review of rules and regulations of the China Association for democracy promotion. The full text is as follows:

Regulations for the filing and examination of regulations and normative documents of the China Association for democracy promotion  

(January 21, 2020 fourteen session of the twenty-one session of the president's office meeting for consideration and approval, February 28, 2020, the Central Committee of the people's Liberation Movement)  

   general provisions  

Article 1 in order to standardize the archival review of the rules and regulations and normative documents of the China Democracy Promotion Association (hereinafter referred to as the "people's Republic of China"), and to safeguard the authority, unity, systematicness, standardization and validity of the rules and regulations of the people's Republic of China, the provisions are formulated in accordance with the regulations on the formulation of rules and regulations of the China Association for democracy promotion.

The second provision applies to the review and approval work of the people's progressive central committee, the committees of the provinces, autonomous regions and municipalities directly under the central government and the institutions directly under the central government of the people's Republic of China (hereinafter referred to as the "reporting authorities").

The normative documents referred to in these Provisions refer to documents which are generally binding and can be applied repeatedly in a certain period in the course of carrying out functions and self construction.

The following documents are not included in the scope of filing review:

(1) printing and issuing papers on leadership speech, annual work highlights and work summary;

(two) documents concerning personnel adjustment, recognition of awards, disposition and daily management of the working organs;

(three) documents such as requesting, reporting, meeting activities, meeting minutes, briefing, etc.

(four) other documents which do not require filing review according to regulations.

The third record review work should follow the following principles:

(1) if there is a requirement, all those that belong to the scope of the record review shall be reported promptly, and no concealment, missing reporting or delay reporting shall be made.

(two) there must be a necessary trial, and timely and strict examination of the rules and regulations of the people's Republic of China and normative documents should be made.

(three) mistakes must be corrected. The problems identified in the review should be dealt with according to the regulations, and no discount or flexibility should be made.

The fourth Central Committee of the people's progressive government (hereinafter referred to as the "censorship authority") bears the main responsibility for the archival review work.

The general office of the Central Committee of the people's Republic of China is responsible for conducting the record review work as a review organization. The relevant departments and units should actively assist in carrying out the archival review work within the scope of their duties and jointly play the role of censorship.

The newspaper office is responsible for implementing the work arrangements of the censorship organs, and actively carrying out the archival review work according to the requirements of the duties.

  The second chapter is newspaper preparation.  

The fifth regulations and normative documents that should be reported in accordance with these Provisions shall be submitted by the newspaper organ within 30 days from the date of approval.

Failing to submit a report in accordance with the prescribed time limit, the examining organ shall order it to make a supplementary report within a specified time limit, and may notify it if necessary.

The sixth article reports on the rules and regulations of the people's Republic of China and the normative documents. It should submit a record report, a formal text and a record description, in 3 copies, and submit an electronic text.

The archival report is a formal official document, and the archival matters are reported to the censorship organ.

The record description should include the necessity, basis, drafting process, main contents, sources of important data indicators, consultation and consultation, deliberation and approval, etc.

The seventh reporting organs shall submit the regulations of the people's Republic of China and the normative documents issued in the previous year to the censorship authorities for reference before February 1st each year.

   The third chapter reviews  

The eighth examination organs shall register the rules and regulations and normative documents submitted for compliance with the requirements of the examination, and examine them from the following aspects:

(1) whether it is consistent with the principles laid down in the sixth provision of the regulations on rules and regulations of the China Council for the promotion of democracy;

(two) whether it conflicts with the rules and regulations of the higher authorities and whether it is in conflict with the regulations of the same place on the same matter;

(three) whether it is in conformity with the authority and procedure;

(four) whether it is suited to the development needs of the situation;

(five) whether the contents stipulated are obviously improper;

(six) whether the name is used properly, whether the format is correct or not;

(seven) other issues that need to be audited.

Ninth, in view of the problems found in the examination or the opinions and suggestions of the parties concerned, the examination organ may request the newspaper office to make explanations.

The reporting organ shall explain the reasons and basis for the relevant matters within the prescribed time limit, and may also propose handling measures.

   The fourth chapter deals with  

The tenth examination organs shall, according to different situations, make corresponding decisions on the rules and regulations and normative documents of the people's Republic of China, and urge the newspaper and retrieval agencies to handle them in a timely manner. The decision on examination and treatment shall be examined and approved in accordance with the prescribed powers and procedures. The reporting organ shall conscientiously implement the decision of the examining organ.

Eleventh, the rules and regulations of the people's Republic of China that do not find problems in the review and normative documents shall be directly passed by the censorship organ, and timely feedback to the reporting organs.

If the censorship finds that there are problems in the rules and regulations and normative documents adopted by the censorship, it may restart the review process.

There are no principled problems in the twelfth articles of the people's Republic of China on the rules and regulations of the people's Republic of China. However, under one of the following circumstances, the censorship organ may file the record for adoption and submit a written reminder to the reporting organ:

(1) the relevant political statements are not standard enough.

(two) there may be deviations or misunderstandings in the implementation of the relevant provisions;

(three) the relevant provisions are not reasonable enough;

(four) the formulation procedure is not standardized;

(five) changes in the spirit of the higher authorities or the imminent introduction of new measures need to be reported to the authorities for understanding.

(six) the use of names, style and format, and wording are not standardized.

(seven) other situations that need to be reminded.

The newspaper office should initiate rectification after receiving written reminder, and report the situation to the review authority within 30 days.

Thirteenth of the following civil and administrative regulations and normative documents that are reported are in the following circumstances: the censorship authority shall not pass the record, and require the reporting organ to rectify:

(1) violation of the principles of political nature and legality;

(two) conflict with the rules and regulations of the upper part of the people's Republic of China and the normative documents.

(three) obviously unreasonable;

(four) does not conform to the limits of authority;

(five) other situations that need to be corrected.

The reporting organ shall report the relevant treatment within 30 days after receiving the rectification request.

After the rectification of the rules and regulations of the people's Republic of China and the normative documents meet the requirements, the examination organ shall record the procedures according to the procedures. If the reporting office fails to correct problems within the prescribed time limit or report relevant corrective measures and has no justifiable reasons, the examination organ may make a decision to cancel relevant regulations and normative documents of the people's Republic of China.

Fourteenth, for the civil procedure rules and regulatory documents that have not found any problems, the examination organ usually completes the examination and processing within 30 days. If any problems are found, the time for examination and treatment may be appropriately extended, but generally not exceeding 3 months.

Archival review work should be archived for future reference.

The fifteenth review organs should promptly comb out the problems found in the review, strengthen the comprehensive analysis and utilization, and promote the improvement of the system and improvement. The relevant results can be notified within a certain range.

The sixteenth examination and evaluation, reward, supervision and disciplinary action shall be carried out according to the state laws and regulations, the supervisory system and the relevant rules and regulations of the association.

   Fifth chapter supplementary provisions  

The seventeenth committees of the provinces, autonomous regions and municipalities directly under the central government shall establish a corresponding filing review system in accordance with the spirit of these Provisions, and carry out the archival review work according to the principle of "preparation at the first level".

The eighteenth provision is explained by the general office of the Central Committee for the people's advancement.

The nineteenth provision shall come into force on the date of promulgation.
